PROPOSAL:

Erection of a village hall and associated infrastructure

LOCATION:

Cow Lane, Womersley

RECOMMENDATION:

Planning Permission be Granted subject to

 

Consultation response: NYC Minerals and Waste team

 

The Old School, Cow Lane, Womersley is within a Minerals and Waste Safeguarding Area for Brick Clay and Limestone, however, does not fall within the exemption criteria stated in paragraph 8.55 of the MWJP (2022). Therefore, the relevant policy to consider in this instance is:

 

Policy S02 (Developments proposed within Safeguarded Surface Mineral Resource areas), which specifies that the application should include an assessment of the effect of the proposed development on the mineral resource beneath or adjacent to the site of the proposed development. But given the small scale of the proposed development a minerals assessment is not required on this occasion and there are no further comments to make.

 

This does not change the recommendation.

 

Consultation response: Sport England

 

Sport England have been consulted through the life of the application and the scheme has been amended to address concerns raised. An objection has been raised to the latest iteration of the amended plans.

Should the local planning authority be minded to grant planning permission for the proposal, contrary to Sport England’s objection then in accordance with The Town and Country Planning (Consultation) (England) Direction 2021, the application should be referred to the Secretary of State, via the Planning Casework Unit.

However, Sport England states that it will review this position if the applicant:

·         Omits the proposed footpath.

·         Amends the location of the proposed footpath so that is directly against the boundary of the playing field and submits a plan to show how the proposed footpath will not impact on the ability for the playing field to be marked out with a range of pitches.

 

 

Officers have requested a new site plan showing the footpath be realigned on the southern boundary and Sport England will then be reconsulted.  The applicant has agreed to provide this.

 

No response received as yet from Yorkshire Water or the Environment Agency
